JUBA, July 22, 2026 — His Excellency President Salva Kiir Mayardit has formally assented to the Revitalized Agreement on the Resolution of the Conflict in the Republic of South Sudan (R-ARCSS), 2018, (Amendment 2026), clearing the legal pathway for the conduct of South Sudan’s national elections scheduled for December 2026.

The presidential assent marks a significant milestone in the implementation of the Revitalized Peace Agreement by delinking the legal provisions that had previously linked the conduct of elections to the completion of the permanent constitution-making process and the national population census.

Pursuant to Article 8.4 of the Revitalized Agreement on the Resolution of the Conflict in the Republic of South Sudan (R-ARCSS), 2018, and Articles 57(d) and 101(n) of the Transitional Constitution of the Republic of South Sudan, 2011 (as amended), the presidential assent formally enacts the R-ARCSS (Amendment) Act, 2026, following its ratification by the Transitional National Legislature under TNL Resolution No. 05/2026.

The amendment achieves a key objective of the peace implementation process by delinking the conduct of national elections from the completion of the permanent constitution-making process and the national population census, thereby establishing a clear constitutional and legal framework for the country’s democratic transition.

With His Excellency’s signature, the amendment now transitions into binding national law, providing the legal certainty required for the conduct of free, fair, and credible elections in accordance with the Constitution and the electoral laws of the Republic of South Sudan.

The Executive Branch, under the leadership of the Ministry of Presidential Affairs and the Ministry of Justice and Constitutional Affairs, is prepared to undertake the next phase of implementation. This includes harmonizing the Transitional Constitution of the Republic of South Sudan, 2011 (TCRSS 2011), as amended, with the newly enacted provisions, as well as aligning the National Elections Act to ensure full consistency with the revised constitutional and legal framework.

The enactment of the amendment represents a major step in advancing the implementation of the Revitalized Peace Agreement and reinforces the Government’s commitment to delivering peaceful, credible, and constitutional elections in December 2026, allowing the people of South Sudan to exercise their democratic right to elect their leaders.
